These terms and conditions (the "Terms and Conditions") govern all purchases and sales of tours, travel, services and products between JoyRides Tours Inc, 46 N Orange Blossom Trail, Orlando, FL 32805, a California corporation (entity number: C3712304, EIN 47-1932028), hereafter referred to as "JoyRides" "We" or "Us", and Customer, hereafter referred to as "You" or 'Your".

These Terms and Conditions, along with Your order, confirmed by a written order confirmation and/or payment confirmation and/or specified invoice and payment plan, constitute the entire contract between You and JoyRides. By placing an order with JoyRides through our websites www.joyrides.no/se/dk/fi and/or www.explorifytours.com (also referred to as "Web Shop") You agree to be bound by these Terms and Conditions as well as the terms and conditions of JoyRides AS/AB, Explorify AS/AB/INC/LLC, Explorify Tours LLC, Explorify Rentals LLC and all companies and/or partners that will be used to deliver the services and products included in Your order.

These Terms and Conditions affect Your legal rights and obligations. If You do not agree to be bound by the Terms and Conditions, please do not place an order with JoyRides on our websites; www.joyrides.no/se/dk/fi and/or www.explorifytours.com.

Our "Guided Tours", "Self-drive Tours", "Road Trips", "Custom Tours" and "Rentals", all have specific terms and conditions covered under separate sections in Terms and Conditions. No agent, employee or representative of JoyRides is authorized to waive our Terms and Conditions, or requirements stipulated by the laws and regulations under which Joyrides operates.

GENERAL TERMS

To make a purchase on www.joyrides.no/se/dk/fi and/or www.explorifytours.com you must be 21 years old, have at least one year of driving experience on a heavy motorcycle/car, as applicable, a valid driver's license for the operation of the subject vehicle and a credit card from a major card company (Visa, MasterCard, Diners, American Express, etc.). No debit and/or pre-paid cards are accepted.

By placing an order on www.joyrides.no/se/dk/fi and/or www.explorifytours.com You accept our Terms & Conditions as set forth on Our webshop, and any other document that you sign; You acknowledge that you had an opportunity to read the entire Agreement before signing.

Consumer purchases are regulated by Consumer law, Marketing law, the Personal Data Act, E-Commerce Act, Credit Act and the Package Tour Law.

2. Reservations and Purchases

Most of our tours are ticketless. When booking a tour, rental, product or service, You must provide Your email address and (mobile) phone number. It is important that Your contact information is accurate and up-to-date as it is our only way to get in contact with You and notify You of any important changes to Your order.

3.1 Responsibility, Order and Contract Process

Your order becomes binding when the order is registered in our Web Shop on our server (and Your order does not deviate from the terms offered on our Webshop) and We issue a written confirmation of Your order. Read the order confirmation carefully when You receive it to ensure that the confirmation is in compliance with your order.

Please note it is Your responsibility to submit your name exactly as it is written/registered in your passport; all names and letters are included and in the correct sequence. We normally purchase airline tickets for your travel 7-9 months before the departure date of your tour purchase, based on the info you have provided in your booking.

3.2 Your Representations

By placing an order, You represent that:

  • You are at least 21 years of age and in sound medical condition
  • You understand that unique risks are involved in motorcycle riding
  • You possess the skill, knowledge, confidence and experience to operate the vehicle safely
  • You will not operate the motorcycle without wearing a D.O.T. certified helmet
  • You possess a valid driver's license for the entire rental period
  • You are not under the influence of alcohol or controlled substances
  • You possess a valid credit card (No Debit or Pre-paid cards accepted)
  • You carry appropriate levels of travel and medical insurance coverage
  • You are responsible for obtaining all necessary travel documents, including visas and passports

3.3 Guided/Package Tours Include:

  • Car or motorcycle rental, standard model (including unlimited mileage, all taxes, one-way fees)
  • First choice of car/motorcycle
  • SLI insurance (state minimum required by law)
  • Loss Damage Waiver (LDW)
  • Helmet rental (open half shell helmet)
  • Accommodation in shared double room at 2/3+ star motels
  • Pick-up and transport between motel and rental location
  • Free entrance to national parks
  • Professional multi-lingual tour leader
  • Support vehicle with luggage service
  • Gasoline and oil for guided driving
  • Tour book (pdf) with detailed route description
  • T-shirt & Buff
  • Group photos & pictures from the tour

Not Included:

  • Airfare
  • Security deposit for vehicle rental ($100-$2,500)
  • Optional tour-specific attractions
  • Transportation to/from airport/hotel
  • Food and beverages
  • Travel and cancellation insurance

  • Tips & personal expenses

3.4 Self-drive Tours Include:

  • Car or motorcycle rental, standard model (including unlimited mileage)
  • First choice of car/motorcycle
  • SLI insurance (state minimum required by law)
  • Helmet rental
  • Accommodation in shared double room at 2/3+ star motels
  • Pick-up and transport between motel and rental location
  • Tour book (pdf) with detailed route description

3.5 Vehicle Rentals

  • Car/motorcycle rental, 24-hour, standard model, unlimited mileage
  • SLI insurance (state minimum required by law)
  • Helmet rental (open half-shell helmet)
  • Storage of luggage and valuables (at Your own risk)

3.6 Payment

Payment can be made using a major credit card or by bank wire transfer. By clicking "Place Order/Confirm Reservation" at checkout, you give US permission to charge your card(s) according to the specified payment plan below.

  • Deposit: USD 300 per traveler (non-refundable)
  • First Installment: $910 no later than 9 months before departure
  • Second Installment: 50% of remaining balance no later than 100 days before departure
  • Third Installment: Full remaining balance no later than 45 days before departure

Credit Cards: International credit card payments are subject to a 3.95% finance charge. US credit card payments are subject to a 2.5% finance charge.

3.7 Cancellation and No-show

A deposit of USD 300 is non-refundable. The deposit covers administration costs, fees and expenses associated with the fulfillment of Your booking.

  • Cancellation 9+ months before departure: First installment refunded
  • Cancellation 100+ days before departure: Second installment refunded
  • Cancellation 46-99 days before departure: Only Third installment refunded
  • Cancellation 45 days or less before departure: No refunds, full payment required

Refunds, if applicable, will be issued in the form of store credit that can be redeemed within 1 year from the date it was issued. We strongly recommend that You obtain travel and cancellation insurance.

3.8 Store Credit

Store credits are personal and may only be used for reservations booked by and for that specific individual. Store Credits can only be used once per payment and expire 1 year after the issuing date.

3.9 Customer's Acknowledgement

By ordering one of our tours, travel and/or rentals, You acknowledge that You understand that riding or driving a motorized vehicle involves risks and that everyone travels at their own risk. The organizers and their partners cannot be sued or held liable for any accident, loss or damage during the associated travel or tour.

3.10 Rental of Vehicles and Deposit

When You pick up your rental vehicle a security deposit must be "reserved" on your credit card. The amount will vary depending on coverage chosen, normally in the range of $100 to $2,500 per vehicle. Deposits will be refunded if you return the vehicle undamaged.

3.11 Changes in Tour Programs and Cancellations

Tours are organized on a seasonal basis. Where seasonal variances, weather conditions, government regulations, or travel restrictions require changes, the itinerary will be adjusted accordingly. We normally ride with 10-20 bikes in a tour group.

Within 45 days of departure, travel dates may be canceled or moved up to 2-4 weeks forward or backward, depending on availability. In the event of insufficient participants, JoyRides reserves the right to cancel, reschedule or merge Your tour.

3.12 Tour Cancellations

If We have to cancel your tour, You will be offered the tour as a Self-Drive Tour or an alternative guided tour. If you do not accept, We will refund Your payment in full, which constitutes full settlement. We are not liable for additional costs including pre-paid airline tickets, hotel reservations or automobile rentals.

3.13 Policies Concerning Airfare

Our main policy is that all tours are sold with airfare. If you order us to purchase airline tickets, all flights depart to/from the main national airport of the country where You reside.

3.14 Responsibility

We are responsible for providing the services listed in the tour program. We cannot be held liable for any accidents or for any occurrence in connection with the tour which might result in injury, death, or other damage to the client, property, family, heirs, or assigns.

3.15 Luggage

Luggage is limited to one medium-sized suitcase/bag and a travel bag/backpack per person (20-22 kg, 44-48 lbs.). JoyRides takes no responsibility for any loss, damage or delay regarding the delivery of luggage to travelers.

3.16 Insurance and Protection

Beyond the insurance provided through your rental agreement, you are responsible for any damage or loss you cause. Reservations include liability insurance with minimum amounts per state laws. Example California coverage:

  • $15,000 for injury/death to one person
  • $30,000 for injury/death to more than one person
  • $5,000 for damage to property

You are not insured for vehicle Damage or Theft without additional coverage. Please check your insurance coverage with your provider and/or credit card company.

3.17 Supplement Liability Insurance (SLI)

Supplemental Liability Insurance provides supplemental third-party liability insurance at limits excess of state-required minimum. We offer an SLI $300,000 Upgrade Coverage.

3.18 Loss/Theft Damage Waiver Coverage (LDW)

All Loss/Theft Damage Waivers and Supplemental Liability Insurance options are subject to specified terms and conditions. A Police Report is required for all accidents resulting in damage or injury.

3.19 Roadside Assistance

Roadside Assistance Coverage provides towing and roadside assistance if your motorcycle becomes inoperable. Benefits include emergency towing (within 30 miles), emergency fuel delivery (up to 2 gallons) and jump-start services. We will waive costs up to $250 USD per incident.

3.20 Personal & Medical Insurance

To participate in our tours, You must have valid travel and/or medical insurance. We recommend adequate travel, health, and accident insurance with extended coverage for Your tour, as well as Trip Cancellation coverage.

3.21 Proof of Identity

Your order is personal and cannot be transferred. You must present a valid Photo ID on request. You are responsible for obtaining all required travel documents, including visas and passports. JoyRides reserves the right to refuse customers who cannot produce valid identification or necessary travel documents.

3.22 Tour Guides

Tour Guides are there to assist You and will ensure every participant gets the most out of their experience. It is important for all riders to listen carefully to safety and travel instructions.

3.23 Weather Conditions

JoyRides strives to schedule tours when weather is typically pleasant. Weather conditions can change rapidly. JoyRides cannot be held liable for unpleasant weather conditions, and no refunds shall be granted due to such conditions.

3.24 Support Vehicle

For tours with a support vehicle, we offer space for luggage and cold drinks for purchase. The vehicle carries tools, first aid kit(s), and sometimes a spare motorcycle. It is available for emergencies only, not for transporting reluctant or tired riders.

3.25 Alcohol & Drugs

JoyRides follows a strict "No alcohol and/or drug policy" during driving. We encourage responsible drinking when not driving. Tour leaders have the right to demand breathalyzer and/or drug tests and exclude participants who test positive from driving with the group.

3.26 Failure to Comply with Traffic Rules

Tour guides have authority to exclude participants who are a danger to themselves or others. If You do not follow traffic rules or JoyRides' regulations, We have the right to cancel Your tour and secure Your rental vehicle with no right to claim compensation.

3.27 Helmet

Open half helmets are provided with motorcycle rentals and tours. We encourage You to bring Your own helmet to ensure comfort and proper fit.

3.28 Storage

JoyRides will provide storage for additional luggage at the pick-up location while on tour. You store your luggage at your own risk. JoyRides does not take responsibility for lost or stolen items.

3.29 Fuel & Oil

Fuel and oil costs are included on all Guided Tour riding days. JoyRides reserves the right to charge an additional fee if fuel costs significantly exceed average prices at time of order confirmation.

3.30 Responsibility for Vehicle Damage or Loss

If involved in an accident, contact the tour leader immediately. For personal injury, call emergency services (911 in US, 111 in New Zealand). Obtain a Police report of the incident. All damage without a Police Report will be considered the renter's responsibility.

3.31 Your Rights if You Damage Your Rental

If hit by another person and not at fault, the rental company will provide a new vehicle as soon as possible. If you are at fault, your lease and insurance are immediately terminated. You are responsible for all damage unless you purchased adequate insurance coverage.

3.32 Condition and Return of Vehicle

You must return the vehicle on the specified date and time, in the same condition received, except for ordinary wear. An extra cleaning fee may be charged if you have not removed flags, stickers, tape marks, rubber marks, or garbage.

3.33 Special Needs

If You have special needs/requests regarding Your travel, please contact JoyRides' customer service at +1-(800) 395-0591 to book your tour.

4. Information Provided on the Website

We strive to provide accurate information about our tours, travel services and products. We disclaim any typographical or technical errors that may occur. Images, logos, copy, and trademarks are believed to be in the public domain or used with permission. Information may not be used without express written permission.

5. Pricing

Prices include all taxes and fees. Price adjustments may occur due to changes in currency exchange rates or increases in airfare, taxes, or fees. We reserve the right to increase prices up to a maximum of 10% at any time prior to departure based on market changes.

6. Late Fees

Payments not made when due will accrue interest at the rate of 1.5% per month, or at the maximum applicable legal rate.

7. Delivery and Changes

Travel, services and products will be delivered in the manner, at the place and at the time specified in your order confirmation, subject to any changes as specified in Section 3.10 above.

8. Examination of Products

After receiving products, you should inspect them as soon as possible, but no later than three business days after delivery, to determine conformity with the order or if damaged/defective.

9. Your Rights with Non-conforming Products

If products do not materially conform or are defective, You may be entitled to repair, price reduction, or replacement. JoyRides will determine which remedy to provide. Liability is limited to an amount not exceeding the purchase price of the specific product.

Submit complaints in writing as soon as defect is observed, but no later than 15 days after delivery. After this time limit, the right to hold JoyRides liable lapses.

10. Withdrawal

The right of cancellation does not apply to fixed-term/dates benefits, such as tours and travel. For cancellation conditions, see sections 3.7 and 3.10.

11. Personal Information

We collect, process, and use only necessary personal information to fulfill obligations. We reserve the right to run credit checks. Your personal information will only be disclosed when You have consented, when necessary to fulfill our agreement, or when required by law.

12. Force Majeure

If tour execution is hindered or prevented by war, hostilities, weather, labor conflicts, strikes, illness, pandemic, government regulations, travel restrictions or any other cause, JoyRides may cancel Your tour without liability to refund any payments made in advance.

13. Disputes

The parties shall attempt to resolve disputes amicably within thirty (30) days. Disputes shall be resolved through the American Arbitration Association (AAA). The place of Arbitration shall be within Orange County, Florida, USA.

For disputes $250,000 or less, the Arbitration Panel shall consist of one arbitrator. For disputes exceeding $250,000, three arbitrators. The prevailing Party receives compensation for reasonable attorneys' fees and costs.

By agreeing to arbitration, the Parties waive any right to a court or jury trial. Claims statutorily barred from arbitration shall be resolved by the Florida Court in Orange County. The prevailing party shall be entitled to reasonable attorney's fees and costs.

14. Participant Statement and Release of Liability

BY CONFIRMING A PURCHASE TO JOYRIDES, YOU RELEASE JOYRIDES AND ITS RELEASEES FROM LIABILITY.

I acknowledge that operating motorcycles is inherently dangerous and FULLY ASSUME THE RISKS INCLUDING: dangers of collision with pedestrians, vehicles, riders, and objects; surface hazards, equipment failure, inadequate safety equipment, THE RELEASEES' OWN NEGLIGENCE, weather conditions; and possibility of serious physical and/or mental trauma.

For myself, heirs, executors, administrators, legal representatives, assignees, and successors I HEREBY WAIVE, RELEASE, DISCHARGE, HOLD HARMLESS, AND PROMISE NOT TO SUE AND AGREE TO INDEMNIFY the Releasees FROM ANY and all rights and CLAIMS, INCLUDING CLAIMS ARISING FROM THE RELEASEES' OWN NEGLIGENCE.

I certify that I will wear personal protective equipment (including helmet) while operating a motorcycle. I have no physical or medical condition which would endanger myself or others. I will hold a valid motorcycle operator's license and maintain adequate insurance.

I grant JoyRides the absolute right to use any photographs taken of me during the Tour for any purpose including illustration, promotion, advertising, and trade. I grant unrestricted permission to exchange personal information with Harley-Davidson Europe Ltd.

15. Waiver of Liability

YOU RELEASE, WAIVE, DISCHARGE, COVENANT NOT TO SUE AND AGREE TO HOLD HARMLESS JOYRIDES AND ALL RELEASED PARTIES FROM ANY AND ALL CLAIMS, DAMAGES, LOSSES, LIABILITIES, LEGAL PROCEEDINGS, PENALTIES, FINES, OR OTHER SANCTIONS.

This waiver includes injury, damage or loss to your person or property which may be (A) caused by any act, or failure to act, by any Released Party or (B) sustained before, during, or after the rental. This waiver does not release You from any liability caused by Your intentional misconduct or from liability that cannot be effectively released under applicable law.

16. Acknowledgments and Assumption of Risk

I fully understand and acknowledge that operating or riding on a motorcycle has unique risks and that serious injury or death could result through no fault of my own. I EXPRESSLY AGREE TO ASSUME THE ENTIRE RISK OF ANY ACCIDENTS OR PERSONAL INJURY, INCLUDING DEATH, which I might suffer from operating or riding on the Motorcycle.

I possess the skill, knowledge, confidence, and experience to operate the Motorcycle safely, and I hold a current valid motorcycle operator's license. I am not under the influence of alcohol, drugs, or medications that may impair my judgment or ability. I have examined the Motorcycle and am satisfied it is in good operable condition.

I will not allow any other person to operate or ride on the Motorcycle unless specifically permitted by the Rental Company. I agree to operate safely, defensively and within the limits of the law and my abilities. I will only operate on public highways and roads.

Helmet Fitting and Safety

I understand that accurate fitting of my motorcycle helmet is of utmost importance. A poorly fitting helmet will give much less protection, or may even part company with my head in an accident. I acknowledge it is my responsibility to determine which helmet size best fits my head and that the Rental Company is not responsible for determining my proper helmet size.

I agree to wear at all times a properly fitted motorcycle helmet that has been approved by the D.O.T. (or appropriate local government authority). If I am the operator, I will require any passengers to also wear properly fitted approved helmets at all times.
